This Privacy Statement describes how the Nutanix group of companies which includes Nutanix, Inc., Nutanix Netherlands, B.V., and subsidiaries and affiliates, (collectively, “Nutanix”, “we,” “our,” or “us”) collects and uses your information when you visit the website at
https://nutanix-xclaim.com (the "Sites") and use the rewards platform provided by Corporate Rewards Limited (the "Programme"). We are committed to maintaining your privacy and protecting your information when you participate in the Programme or visit the Site. This Privacy Statement explains how we will collect, use and protect your information and how you can exercise your privacy rights.

This Privacy Statement only applies to the processing of your information when you participate in the Programme as an employee of a Nutanix's partner. Who is the Data Controller?

If you are a participant located in the European Economic Area ("EEA") or the United Kingdom, Nutanix Netherlands, B.V. is the data controller of your personal information. To contact us, please use the contact details provided in the "Contact Us" section below. 


INFORMATION WE COLLECT

We collect the information that you voluntarily provide when you use the Site and participate in the Programme, such as when you create an account on the Site or register an event (e.g. a meeting or a call) with a Nutanix's customer's end user or prospect. This includes your name, company, role and professional contact details, the Nutanix's customer's end users or prospects name, company name, role and professional contact details and details about Nutanix customers or prospects, the events logged into the Site and the next steps agreed with the customer's end users or prospects.


Cookies

Information we collect automatically

When you visit the Site or use the Programme, our vendor, Corporate Rewards Limited, who manages this Site and the Programme uses cookies and similar technologies such as web beacons, tags and JavaScript, alone or in conjunction with cookies, to automatically collect certain technical information from your browser or device. In some countries, including Switzerland, United Kingdom and countries in the EEA, this information is considered 'personal data' under data protection laws. Corporate Rewards Limited also collects information about how you use the Site and the Programme to enable and optimize your experience when you visit the Site and participate in the Programme, for functionality purposes, and to allow us to better understand how you interact with the Site and use the Programme.


What do we do with your information?

We use information about you for the following purposes:

  • To create your account and administer the Programme: Corporate Rewards Limited  needs your name, company name, role and professional contact details to register you on the Site and to administer the Programme, including to provide you with rewards based on the events you log on the Site;
  • To optimize our sales efforts:  We collect information in relation to the events your log into the Sites and the customers or prospects to whom they relate in order to engage with our partners to monitor, analyse and optimize our partners' sales efforts. We also use your information to manage and improve our customer relationships;
  • To communicate with you: We use the contact details you provide when you create your account on the Site to communicate (directly or through our vendor) with you about the Programme.
  • To monitor the Program: We use information about the information you log into the Site for assessment and analysis of the Programme performance;

We process your personal information for the purposes described above to the extent it is necessary for our legitimate interest in engaging with our partners to improve our customer and partner relationships and optimize our sales efforts, or where required by applicable law, with your consent.


How long do we keep your personal information for?

We will retain your personal information for the period that you are registered with this Programme.  After the expiration of the Programme (or before if you leave the Programme before it ends), we will retain your personal information where we have an ongoing legitimate business need to do so and for a period of time consistent with the original purpose as described in this Statement. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.


To whom do we disclose your information?

We will not disclose to any third parties, personal information data which relates to you without your prior consent, except as outlined below. We may disclose your information in the following circumstances:

  • Service providers:  In order to manage the Programme and undertake or customer relationship management, it may be necessary for us to disclose your personal information to contracted third parties and service providers who perform certain functions on our behalf. This includes, for example, Corporate Rewards Limited who provide this Programme and Site on our behalf and its service providers (e.g.  cloud hosting providers, communication providers etc.) and our customer relationship management providers.


  • Legal rights: We may disclose information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud or in situations involving potential threats to the safety of any person.


  • Business transfers: We may disclose or transfer your information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third-parties as one of our business assets in which case the acquirer, successor or assignee will use your personal information in line with this Privacy Statement.

International Data Transfers

While the Site and Programme are managed in the EEA, your personal information may be transferred outside of the EEA or your country of origin to the United States or any other countries where Nutanix is established or our third-party service providers operate.
